How Can A Chapter 7 Bankrutpcy Help Me With My Debts?
The Chapter 7 process is what people consider the 'traditional' consumer bankruptcy. It allows you to discharge and eliminate certain types of debt especially credit card and medical bills. In return for the elimination of debt, you may have to give up certain assets, which can be liquidated (sold off) by the bankruptcy court to partially repay your creditors.

The Patricia Geringer law firm professionals will carefully evaluation your circumstances and assist you in determining whether you would be required to give up your home, car or any other assets in order to file a Chapter 7 bankruptcy. Keep in mind that there are ways of working out agreements which will allow you to keep many of your assets. We will also work with you in helping you consider whether Chapter 13 (Reorganization) might be a better option. We will work with you and explain every procedure -- every step of the way.

Do I Qualify For Chapter 7?
The federal bankruptcy law adopted in 2005 set some new qualifications for Chapter 7 bankruptcy. There currently is a mandatory means test which uses your income and the size of your family to screen out people who can afford to repay some of their debts. For these people, Chapter 13 bankruptcy is probably the answer.

Many people who consider bankruptcy simply cannot afford to pay their bills, so the means test is usually not an issue. If your bankruptcy is caused by a business matter, the means test may not apply. At Patricia Geringer Law, we understand the new law and can assist you in determining whether you qualify for the Chapter 7 bankruptcy option. Contact us to discuss your options with an experienced bankruptcy attorney.
