- Q: Are there resident requirements?
A: Yes. You must reside in Nebraska for at least six months before filing bankruptcy.
- Q: Are there time requirements between bankruptcies?
A: Yes. For Chapter 7 there is an eight year period between Chapter 7 bankruptcies. If you've filed a Chapter 7 in the past - you might be able to file a Chapter 13 before eight years. Call us for more information.
- Q: Geographically, what areas of the state of Nebraska do you Serve?
A: We provide legal bankruptcy services to ALL residents of the state of Nebraska. If you live outside of the Metro Omaha area, we can complete most of the process over the phone and by email- In most cases, you will have to attend a creditors' meeting at the nearest Federal Bankruptcy Court.
- If you attend the meeting in either Omaha or Lincoln, Mrs. Geringer will attend with you. If you attend the creditors' meeting in either Grand Island or North Platte, one of our capable associates will attend the meeting with you. Regardless of where the meeting is held, Mrs. Geringer will prepare and review all documents involved and supervise its filing.
Q: Do you serve bankruptcy clients in Iowa?
A: Not personally. Bankruptcy rules and regulations differ by state and we specialize in Nebraska Bankruptcy. However, we can refer you to another attorney in our office who is capable and will follow the fees and policies discussed on this site. In addition, we have associated attorneys in our office who provide an entire range of legal services from immigration to criminal law. Call us for more information.
Q: Can my boyfriend/girlfriend file with me (jointly)?
A: No. You must be legally married in order to file jointly.
Q: Can my ex-wife/ex-husband file with me (jointly)?
A: No. You must be still legally married in order to file jointly.
Q: Can my wife/husband file with me (jointly) if we're seperated?
A: No. Not if you have a legal seperation. If not a legal seperation, you might qualify to file jointly. Call us for additional information.
Q: How do I take the required classes?
A: You can take them over the telphone or on-line.
Q: I'd like to take them on-line but I don't have a computer?
A: We have computers available for our clients to use.
Q: How much do the counseling classes cost?
A: They range in price from $10 to $50 depending upon what you need and which you choose to use.
Q: How do I find these classes?
A: You may only take those classes approved by the court. We have lists and referral cards from a number of various sources.
Q: Do you have payment plans?
A: Yes! If you plan to file a Chapter 7, we will accept you as a client and start preparing your filing upon the payment of $150. However, we can not file your bankruptcy until you have paid the fee in full. If you plan to file a Chapter 13, Payments can be made from your payment plan over the course of the plan itself. We require $309 to file the bankruptcy.
Q: Why don't you have 'extended' payment plans for Chapter 7 bankruptcy like some of the others claim they do?
A: We offer the same payment plans as the others. However, To keep our fees as reasonable as possible for our clients, we do not offer payment plans which extend to after filing of a Chapter 7 bankruptcy. We're unaware that any attorneys do.
Q: Why shouldn't I go with one of the big national law firms?
A: These are simply referral agencies. They refer clients to those paying the most money - not based upon skill or experience!
Q: Your office is way accross town, why shouldn't I just go with an attorney closer?
A: Actually we're right off the Kennedy Expressway with two exits serving our office. We are within 15 minutes of any one within the greater Omaha Metro Area! Would you select a surgeon based upon the distance from their office? An attorney should be selected the same way - taking into account experience and professionalism.
Q: I don't want to go to a small law firm with a dingy office!
A: We have a large - fully revamped and remodeled office. It is staffed with professionals and computerized with the latest technical equipment. Our staff is second to none in the Metro area. Q: I speak spanish, can you help me?
A: We will arrange for a translater to be present.
Q: Do you accept credit cards?
A: We accept credit card payments through PayPal. These can be made 'on-line' or in our office. Please note: credit card payments are credited minus the charges by Pay Pal (approx 8% to 10% of of the payment).
Q: Do you accept personal checks?
A: We do. However, we charge $35 for no fund checks and we require NF checks to be paid within 24 hours.
Q: I'm handicapped, can you help me?
A: Yes! If you live in the Omaha Metro area and wish to visit our office, we have a handicapped entrance. Call us and we'll make arrangements. If you don't wish to visit our office and you live in the Metro Omaha area, we can do most of it over the phone and by email - and visit your home for the rest. If you live outside the Omaha Metro area, we can do all of it by phone, email and U.S.Mail.
Q: I'm making less money now than I was before and am about to lose my home. Can I save my home?
A: If you can show that you earn enough income to make your house payments with enough to make up what you currently owe over a three to five year period, you can generally save your home by filing a chapter 13 bankruptucy.
Q: My home is being auctioned in a week. Can you file a bankruptcy fast enough to save it?
A: Yes, but you'll have to make an appointment immediately!
Q: How do I go about making arrangements to come to your office?
A: We do not take walk-in clients! You will have to make an appointment by calling (local) 402-734-0635 or (Toll-Free) 1-866-734-1911. You can also make an appointment on line by using this short FORM.
Q: I don't live in Omaha, can your office still represent me?
A: Yes! In Nebaska you do not need to live in or travel to Omha in order to complete most aspects of your bankruptcy. Most of your filing can be done by telephone and email. Call us for details.
Q: How do I find your office?

Q: I don't have an automobile. How can I get to your office?
A: There is a bus line running right in front of our office. Use the direction link below and click on the 'bus' icon for route instructions.
Q: How much does it cost to make an appointment?
A: There is no cost or obligation for a first appointment. And since this office charges flat fees for bankruptcy cases, additional appointments are free as well as long as they deal with bankruptcy issues.
Q: What does it mean that additional Chapter 13 fees are taken from the plan?
A: A Chapter 13 plan might take up to five years. During that entire time, your attorney continues to be involved. If you were to pay this in a lump sum, it would be fairly expensive, so its taken out of your plan the same as other creditors.
Q: How much more does it cost me each month to have legal fees taken from my Chapter 13 plan?
A: Since your payments are based upon what you can reasonably afford to make - not on what you owe, it costs you nothing extra!
Q: Wouldn't I save money by going to a 'Document' preperation firm?
A: Not in the long run! You're paying over $300 just to have some forms completed. You still will have to pay court costs and counseling class costs. If problems arise, you might still have to hire an attorney - which could cost you double which we would have charged you in the first place.
Q: I would like to have a credit report completed so I can ensure that I have included all of my creditors. Can you help me?
A: Yes. We can prepare either a two or three source credit report - while you wait. Once completed, the creditor information in the various reports can be immediately incorporated into your bankruptcy documents saving you time and speeding up the process considerably. You pay only for the actual reports themselves. Call us for more information.
